Application of our website terms
By using our website, you agree to be bound by these Website Terms (Terms) and our Privacy Policy.
We, Silky Oaks Children’s Haven (SOCH), may vary these Terms from time to time without notice to you (visitor to our website), continued use of our website indicates your acceptance of any changes made.
Acceptable use of our website
You must not copy, download, modify, scrape or use any part of our website in any way, without prior written consent from us, or infringe upon the intellectual property rights, privacy or confidentiality of SOCH or any third party linked to our website.
You must not introduce viruses, worms, trojans, spyware, malware or any other code which is malicious, destructive or disruptive to us or our website visitors. You do not have permission to access our website, network, servers, plugins or databases without prior written approval.
You are responsible for your own online security, we are not liable for any loss or damage caused by any software, code, hacking event or similar, while you visit our website.
Website access, liability and indemnity
We may need to restrict access to our website, in whole or in part, to make updates, upgrades or even to close it down. If this occurs, we are not liable for any loss you incur while you visit our website.

We own, or are the licensee of, the intellectual property rights of the content available on our website, including but not limited to logos, trademarks, text, photos, graphics, advertisements, databases, documents, audio and video.
Our Terms do not transfer any intellectual property rights in the content to you or any third parties.
You may link, reproduce, communicate, download or otherwise distribute our content for your own non-commercial use, providing you do not modify our content to misrepresent us or others, in a biased, unreasonable, illegal or damaging manner. You may not link or use our logos, branding, trademarks without obtaining written permission to do so.
The content on our website has been carefully reviewed and is believed to be true and reliable, however we do not warrant or guarantee, nor can we accept responsibility for its accuracy or completeness for any purpose. These websites are not subject to our privacy policy, and we are not responsible for the content found on these websites or the privacy practices of these sites. By utilising our website, you consent to receiving communication from us, either via email, SMS, message or social media. We may also call you by phone if you provide your phone number to us through your online interactions with us.
Donations made from our website
SOCH is a registered public benevolent institution (PBI), which means we’re an institution that is both a registered charity as well as being registered with the ACNC as a public benevolent institution. This entitles us to receive income tax deductible gifts and tax-deductible contributions, as a Deductible Gift Recipient (DGR).
Donations to SOCH can be made through our website, through one-off or recurring donations using electronic means, such as;
- Stripe, Square and PayPal
- Credit and debit cards
- Direct bank transfers
We can also receive in-person donations via cheque, credit or debit card (manual transaction).
Our Privacy Policy contains information on how SOCH uses, stores and may share your personal information when making a donation.
SOCH directs donations towards the charitable purpose intended by the donor, when specified. Where general donations are received, SOCH determines how these donations are to be directed towards its charitable purposes.
If you make a donation to SOCH, a tax receipt will be issued if the necessary details have been provided by you when making your donation. SOCH also accepts anonymous donations, but we are unable to issue a tax receipt in these circumstances.
If a refund of a donation is requested, you must contact SOCH within fourteen (14) days of receipt of payment being able to provide details relating to the payment including but not limited to; the remittance advice from your bank, bank account details, the amount, the date and the circumstances justifying your request for a refund.
Please note that SOCH is under no obligation to provide a refund, and that the decision will be made at SOCH’s sole discretion. If SOCH suspects any fraudulent or malicious behaviour relating to the refund request, we will report the request to the relevant authorities.
Online forms and reviews
We provide online forms to receive genuine engagement with our community, clients or stakeholders. We do not provide our online forms or email addresses to misused by others.
Our workers read and evaluate every email received, in view to actioning genuine requests for support or information, however we reserve the right to delete, ignore or report any inappropriate communication received that is not legal or reasonable.
If an online review is provided and we consider it to be untrue, unreasonable, illegal or maligns us in any way, we reserve the right to investigate and report it to the review platform, in view to having it independently assessed and removed to prevent any reputational damage.
Legal
For the avoidance of all doubt, our website Terms do not establish any employment, partnership, agreement or joint venture contract with any visitor or third party accessing our website.
Any failure on our part to enforce these Terms is not a waiver of our rights, nor will it affect the validity of our Terms. If any part of these Terms is considered by a court to be illegal, invalid or unenforceable under the applicable law, that clause, provision or term will be severed from the Terms and the remaining terms will be unaffected.
These Terms are governed by, and construed in accordance with, the laws of the State of Queensland, in Australia and the courts of that jurisdiction will have non-exclusive jurisdiction over any dispute arising out of these Terms.
